1. Acceptance of these terms
These Terms of Service govern your use of the Aquairi mobile app and the aquairi.app website (together, the “Service”), operated by Aquairi (“we”, “us”). By creating an account or using the Service you agree to these terms. If you do not agree, please do not use the Service.
2. What Aquairi is
Aquairi is an aquarium management service: a diary for water parameters, inhabitants, equipment, and maintenance, with AI-generated insights, optional IoT device monitoring, a public knowledge base, and community features. We continuously improve the Service and may add, change, or remove features over time.
3. Your account
You need an account for most features. Sign-in uses one-time email codes — keep access to your email secure, as you are responsible for activity under your account. You must be at least 13 years old. Provide accurate information and let us know if you suspect unauthorized use of your account.
4. Subscriptions and billing
Aquairi’s core features are free. Premium plans (AI Premium, IoT Premium) and the storage add-on are sold as in-app purchases through the Apple App Store or Google Play and are processed by those stores — we never see your payment details. New accounts include a 30-day free trial with no card required. Subscriptions renew automatically until cancelled in your store account settings; cancellation takes effect at the end of the current billing period. Refunds are handled according to the policies of the respective store. Purchases require you to be of the age of majority in your country, or to have permission from a parent or guardian.
5. Acceptable use
Do not misuse the Service. In particular: no unlawful content, no harassment or hate speech, no spam, no impersonation, no attempts to break, overload, or reverse-engineer the Service, and no scraping or automated bulk access outside our public API. We may remove content and restrict accounts that violate these rules.
6. Your content
You keep ownership of everything you post — photos, posts, comments, and aquarium data. By posting publicly you grant us a non-exclusive, worldwide license to host, display, and share that content as part of the Service (for example in the community feed and on public share pages). You are responsible for your content and must have the rights to share it.
7. Intellectual property
The Service itself — including the app, website, design, logos, knowledge base texts, and software — belongs to Aquairi or its licensors and is protected by intellectual property laws. These terms do not grant you any right to use our branding without permission.
8. Disclaimers
Aquairi’s AI insights, Health Score, and care recommendations are informational only — they are not veterinary, medical, or other professional advice. Always use your own judgment and consult a qualified specialist for serious livestock health issues. The Service is provided “as is” without warranties of any kind to the extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, Aquairi is not liable for indirect, incidental, or consequential damages — including loss of data, profits, or livestock — arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
10. Termination
You can stop using the Service and delete your account at any time from the app settings. We may suspend or terminate accounts that violate these terms or harm the Service or other users. Sections that by their nature should survive termination (such as content licenses, disclaimers, and liability limits) survive.
11. Changes to these terms
We may update these terms as the Service evolves or the law requires. The version in force is identified by the date at the top of this page. For material changes we will give reasonable notice in the app or by email and, where appropriate, ask you to review and accept the updated terms before you keep using the Service. Continuing to use the Service after an update takes effect means you accept the revised terms.
12. Governing law
These terms are governed by the laws of the jurisdiction where Aquairi is established, without regard to conflict-of-law rules. We will update this section with the specific jurisdiction; mandatory consumer protections of your country of residence remain unaffected.
